Acceptance
By downloading, installing, accessing or using AiWithApi (the "App" or "Service"), you acknowledge that you have read, understood and agree to be bound by these Terms and the Privacy Policy. If you do not agree, do not use the App.

Service Description
The App provides a chat interface that lets you use your own API keys to send requests to third‑party AI providers (including Google Gemini, OpenAI, OpenRouter and others). The App does not host AI models nor process chat content on servers under our control.
Key Features: Local-first data storage, multi-provider AI access, flexible model switching, and full privacy control.

Accounts, API Keys and Costs
- You are solely responsible for safeguarding and using your API keys.
- Any model usage fees are billed directly by the relevant provider and are your sole responsibility.
- If in‑app purchases/subscriptions are offered (e.g., via RevenueCat), they apply to App features only, not to third‑party model usage fees. The applicable terms will be shown in the purchase flow.

Acceptable Use
Do not use the Service for unlawful, harmful or infringing purposes, including but not limited to: IP infringement, privacy violations, harassment, defamation, malware distribution, rate‑limit circumvention, abusive automation, or any use that violates provider terms (Google, OpenAI, OpenRouter, etc.).

AI Outputs – No Advice, Risks and Disclaimers
- AI outputs may be inaccurate, misleading, offensive or inappropriate. They are provided "as is" and may require human verification.
- Outputs are not legal, medical, financial or other professional advice. Decisions based on outputs are at your sole risk.
- You represent you have all rights to any content you submit and that your use of inputs/outputs does not infringe third‑party rights.

Privacy and Security
- Local‑First: data is stored locally on your device. We do not store keys or chats on our servers.
- API keys are stored using encrypted Secure Storage on device.
- When you use third‑party models, the content you submit is sent directly to the chosen provider and is subject to that provider's terms and privacy policies, which we do not control.
- We may use third‑party services to manage purchases/subscriptions (e.g., RevenueCat). Minimal operational data may be transmitted as needed and will not include chat content.
Privacy First: Your conversations and API keys never leave your device. We prioritize your privacy above all else.

Intellectual Property
- All rights in the App (code, design, trademarks) are reserved by the owner.
- Your content remains yours. You grant us a non‑exclusive, worldwide, royalty‑free, revocable license to use such content solely to operate the App on your device.

Changes, Suspension and Termination
We may update, suspend or discontinue the Service (in whole or in part) at any time, with or without notice. We may terminate or restrict access for violations of these Terms.

Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, reliability, availability, accuracy or non‑infringement. We are not responsible for interruptions, local data loss or third‑party failures.

Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, special, consequential or incidental damages, or for lost profits, goodwill or data, arising out of or related to the use of or inability to use the Service. Without limiting the foregoing, our aggregate liability to you, if any, shall not exceed the amounts you actually paid to us for the Service in the 12 months preceding the event.

Indemnification
You will defend, indemnify and hold us (and our officers, employees and contractors) harmless from any claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, infringing content, or violation of law/third‑party rights.

Governing Law and Venue
These Terms are governed by the laws of the State of Israel. Exclusive jurisdiction and venue shall lie with the competent courts in Tel Aviv–Jaffa, subject to any mandatory consumer protection laws that may apply.

Changes to Terms
We may update these Terms from time to time. We will publish the updated version in the App. Your continued use after an update constitutes acceptance of the revised Terms.
